Magistrates' returns

  • GR-3710
  • Series
  • 1963-1971

The series consists of magistrates’ returns sent to, and subsequently filed by, the Prince Rupert County Court between 1963 and 1971. The returns were generated by magistrates operating in Prince Rupert as well as in locations on Haida Gwaii (then known as the Queen Charlotte Islands), in Cassiar, Hixon, Bella Coola, Port Edward, Clinton, Ocean Falls, Eddontenajon and Yukon Territory, among others. Records in this series list the name of person convicted, nature of offense, date of conviction, amount of fine, amount of costs, and total. The returns list individuals charged under both the federal and provincial legislation and provide evidence of judicial operations in remote BC and Yukon settlements.

The records appear to have originally been housed in shannon folders, but the records were removed and placed in folders prior to transferal to the Archives. The records are arranged both by receipt number, which was often handwritten under the Prince Rupert County Court stamp, or alphabetically by magistrate’s surname. The records are then arranged chronologically by year.

Records in this series were managed and selected for retention under ORCS 50000-01 of the Court Services Operational Records Classification System (schedule 100152).

Terrain Resource Information Management inspection forms

  • GR-3713
  • Series
  • 1986 - 1995

The series consists of data acquisition and quality control records relating to base mapping (the process of mapping the provincial terrain – that is, land and water features). All base mapping was managed through the Terrain Resource Information Management (TRIM) program. TRIM provides the base data for the Province of British Columbia, operating under the Land Act. TRIM is a set of three-dimensional digital files that support development and management of land-related information.

The original TRIM program and mapping projects began in 1988 and were completed in 1996. Demand for more information on features such as roads, streams and forest openings led to the development of the TRIM II program. Mapping projects after December 1996 follow a new set of standards and are used to update and maintain the TRIM program.

The files consist of textual output of technical and background information for maps, rather than maps. These digital mapping group records include statistical summaries for map sheets, data checking and editing printouts, inspection check lists involving inspection and quality control checks which were carried out and indicated in the enclosed forms. Files include information on contractors. Dates given in the file list are sometimes approximate.

The creating office (the Surveys and Resource Mapping Branch, operations section) the most recent records was part of the Ministry of Environment, Lands and Parks. Previous creating ministries included the Ministry of Crown Lands and BC Ministry of Environment and Parks.

Vernon Supreme Court probate cause books

  • GR-3723
  • Series
  • 1901-1960

The series consists of volumes of probate cause books created by the Supreme Court of Vernon between 1901 and 1960. A typical entry lists the name of the deceased, the file number, and a listing of activities that took place during the process of proving the will, as well as the cost of each activity. This can include, but is not limited to, a listing of affidavits that were submitted to the court, and the date that the letters of administration were granted to the execut-or/trix. In some cases, the executor or executrix is named.

Entries in the cause book are arranged chronologically by the date of the first activity in the proceedings. Each volume is accompanied by an alphabetical index.

Records of Assistant Deputy Minister, A.L. Pearson

  • GR-3727
  • Series
  • 1929-1980

The records were created by Alexander Lloyd Pearson during his tenure as the Assistant Deputy Minister in the Ministry of the Attorney General. The records provide evidence of the workings of the Courts system and the Ministry of Attorney General, as well as the process by which legislation was amended and revised. Records in this series are both administrative and operational in nature. Administrative records reflect the day-to-day workings of the Ministry, and include blanks and drafts of forms, transcripts of how court proceedings should be held, budgetary records, organizational charts, salary information, and general circulars and memos. Operational records include correspondence regarding judicial appointments, judges’ personnel files, minutes from the Board of Arbitration (Residence and Responsibility Act), and a subset of records related to the amendment of the Coroner’s Act.

Pearson appears to have been copied on much of the Ministry’s correspondence and its circulars, and many records that do not relate directly to him can be found in the series. As such, the records provide a good overview of the operations of the Ministry of Attorney General and provide evidence of the influence and oversight responsibilities that Pearson held. Pearson also appears to have maintained a number of records relating to estate administration and the probating of wills. It is not clear why these were filed with Pearson’s records, and their relation to the surrounding records is often unclear. Pearson may have intervened with particularly difficult cases, or he may have simply kept copies of the records as examples for his own personal reference. Individuals whose records are included in Pearson’s files include John Hyland (will dated 1903), Robert Hyland (will dated 1930) Enoch Sage (d. 1945), and Hannah Maria Gibson (d. 1946)

The series also consists of a subseries of records relating to the 1975 Keenleyside report, a comprehensive review of the Fire Marshal’s office. The Keenleyside records in this series were created between 1973 and 1975 and include limited correspondence, sample circulars, and material gathered during his research.

Containers 870019-0003 and 870019-0004 contain the remains of alpha files. For the sake of preservation, the records have been rehoused into acid-free holders, but they appear to have originally been housed in a drawer with alphabetical dividers. The alphabetical classification appears to have been based on a number of criteria, including subject term or the names of individuals included in the records. In many cases, records appear to have been misfiled, but as the filing system appears to have been somewhat loose, this may not be the case. Folders have been labelled with the original alpha heading from the divider, and suggestions have been made in square brackets when appropriate.

Four files included in in container 870019-0006 were sent off-site with a note prior to being transferred to the Archives. They were found amongst the papers of another Ministry employee and were arbitrarily placed in the last box of the accession as records management staff could no longer determine where they belonged. The file code written on the file folders may not have been the original one assigned by the Ministry of Attorney General.

Kamloops Supreme Court wills

  • GR-3730
  • Series
  • 1986-2004

The series consists of original wills filed in the Supreme Court of Kamloops between 1986 and 2004. The wills are filed by a sequential number that also corresponds to a probate case file number found in GR-3001. The wills appear to be originals that were removed from the probate case files and filed separately. Not every individual with a probate file had a will.

A nominal index to probates can be found in GR-3001. Once a case file number has been found, this can be used to locate the correct file in the wills series.

New Westminster Supreme and County Court indexes

  • GR-3745
  • Series
  • 1978-1981

The series consists of photocopies of computer printouts of court indexes. Although copies in this series were created by the New Westminster County Court, the indexes refer to records created by several levels of the court system, including both the Supreme and County Courts in New Westminster. The series covers civil cases initiated between 1978 and 1981. The indexes list the date of initiation, the name of the individual or business involved, whether that individual or business is the plaintiff or defendant, and the case number.

These copies of the indexes were created for staff at the BC Archives prior to the transferal of original indexes from the New Westminster courts. They were retained as a reference set, although they are likely to have been mostly or completely superseded with the subsequent transferal of various indexes from the courts.

The indexes list a variety of cases, including but not limited to divorces and probates. Records in this series are arranged first by year and then alphabetically within the year groupings.

Prince George Supreme Court divorce cause books and case record cards

  • GR-3740
  • Series
  • 1961-1984

The series consists of cause books and case record cards for divorces in the Prince George Supreme Court between 1961 and 1984. The cause books and case cards can be used to find a volume and folio number, which can then be used to obtain a copy of the final divorce order. Cause books and case record cards often provide the only remaining evidence of a case if it was abandoned or dismissed, and no order was issued.

Cause books were used by the courts until approximately the mid 1970s. After this time, case cards were used until the courts turned to digital systems in the 1990s. Cause book and case card entries typically include the date of filing, the date and place of marriage, the names of the parties and their solicitors, and an account of the case proceedings. Entries in the cause book and case record cards are arranged chronologically by filing date.

New Westminster divorce trial books

  • GR-3747
  • Series
  • 1957-1977

The series consists of six volumes of divorce trial record books created by the New Westminster Supreme Court between 1957 and 1977. The books are arranged in a similar manner to divorce cause books, but list the Central Divorce Registry file number rather than a volume and folio number. Divorce trial books also provide a list of exhibits used in the case, and the names of individuals who provided affidavits.

Similar to cause books, trial books provide evidence of divorce proceedings that may later have been abandoned or dismissed, thereby not resulting in a divorce order. In these cases, the trial record book and cause book may be the only evidence that still exists of such cases.

Records in the trial books are arranged chronologically from the back of the volume to the front, and are assigned a four-digit number in addition to the number provided by the Central Divorce Registry. Please see GR-3748 for alphabetical indexes to these volumes.

Researchers should note that the volumes were frequently referred to as "Divorce and Matrimonial Causes record books." This is in reference to legislation which governed divorces in BC until 1972, and does not refer to the type of court record known as a cause book.

NTS lot location index

  • GR-3785
  • Series
  • 1973-1983

The series consists of copies of files of lot indexes created between 1973 and 1983 by the Legal Surveys Division of the Surveys and Land Records Branch of the Ministry of Lands, Parks and Housing and its predecessor body, the Surveys and Mapping Branch of the Department of Lands, Forest and Water Resources.

The files are arranged by land districts, with two duotang indexes for each district. Each file contains index information based on the National Topographic System (NTS) of map numbering. The index gives the location of every district lot within an area measuring 7 minutes and 30 seconds in both latitude and longitude. Each file also contains a map of each land district, overlayed by the NTS.

The first set of indexes, in black duotangs, were created between 1973 and 1975 and the second set, in red duotangs, were created between 1977 and 1983. The indexes were updated by the branch annually to show newly created lots and could be used with Departmental Reference maps that had been gridded with the NTS breakdown.

Analyses for legal cases

  • GR-3789
  • Series
  • 1981-1988

The series contains primarily reports of sample testing conducted by the Environmental Lab for legal cases. These legal cases involve the B.C. Provincial Government and companies or their owners who were accused of violating environmental acts (such as the Fisheries Act), usually by knowingly depositing harmful substances into the environment which could affect ecosystems. The reports contain information about which samples (usually water) were dropped off at the Environmental Lab, by whom, in what type of bottles and the location and time of sampling. The reports also list the results of which chemical compounds were found in the samples and at what concentration.

While the reports include a legal case number, they do not summarize the findings or comment on the results in relation to the case or its harmfulness to the environment. Some files, labeled by case number, contain additional records including the name of the accused (usually a business), shipping receipts for the samples, and on occasion a subpoena requesting that a chemist from the Environmental Laboratory appear in court as a witness. As the Environmental Laboratory was summoned to these cases as a witness and is not directly involved with prosecution, there are no details of the actual court cases. One file contains a letter from a solicitor commenting on the short-notice of the subpoena but contains no solicitor-client advice and therefore is not restricted.

The series also contains a box of metal pieces assumed to have been used during the analysis process.

This series contains records relating to land use management in various parts of the province. The records document the creation and activities of various committees established by the planning region to address specific projects as needed.

The records represent the work of committees dedicated to the management of planning teams, emergency and disaster responses, information sharing, consultation guidelines, information management, safety, construction projects and communications.

Part of the series includes the Vedder River Management Committee which was chaired by the Water Management Branch. Other members included representatives from the Engineering Section of the Water Management Branch, Fisheries and Oceans, Fish and Wildlife Management, Inspector of Dykes, Ministry of Agriculture and the District of Chilliwack.

The records from the Peace Managers concern land management committees in the Northern Interior region as well their sub-committees. The records come from the office of Don Roberts of BC Parks; Peace Liard District who was the chair of Peace Managers (IAMC) and the Peace Manager's Oil and Gas Committee. There are representatives from various provincial agencies including : Ministry of Forests, BC Environment, Ministry of Energy and Mines, BC Parks, Ministry of Agriculture and Food, BC Assets and Lands Corporation, Oil and Gas Commission, Ministry of Transportation and Highways, Land Use Coordination Office and Muskwa-Kechina (Program Manager).

The Deputy Minister's Committee on Drought was established in 2003 following a severe drought in British Columbia that put pressure on many water resources. This multi-agency committee and task force conducted studies on precipitation, temperature and ground water conditions in addition to proposing several action plans and programs to help with water conservation. Their records relate to presentations and tours on water conservation, proposals and a list of options for consideration, as well as update reports. The committee disbanded in 2005 however many of the programs continued to be monitored.

The records in this series also show other forms of land management including projects to build dykes, remove gravel, establish campgrounds, restore natural habitat (particularly for salmon species), build infrastructure and grant land leases for farming, public works and other initiatives. Records include memos, meeting minutes, lease guidelines and copies, maps, blueprints, correspondence, expense reports, approvals, invoices and project reports.

Land resource management planning files : First Nations

  • GR-3781
  • Series
  • 1995-1997

This series consists of records related to land resource management planning (LRMP) activities, specifically those of the First Nations Working Group of the Integrated Resource Planning Committee who were responsible for the inquiry into First Nations’ consultation and participation in planning. The records come from the Evaluation and Economics Branch of the Policy, Planning and Legislation Department, B.C. Ministry of Environment, Lands and Parks. Specifically, most records appear to be those created and collected by Algis Janusauskas, co-chair of the First Nations Working Group. Records include his speaking notes for meetings and presentations, correspondence and annotated draft reports written by him or others within the branch or the working group.

The series does not appear to contain records from any actual consultations or negotiations with Indigenous groups, rather the records relate to ways the Ministry and Department might approach First Nations, survey the potential interests of First Nations in land-use planning and assess the lack of participation from Indigenous groups. It also includes reports that were produced after consultations with different Indigenous groups. A number of these reports were prepared internally and by external consulting groups. They include reports such as A Guiding Direction for First Nation Involvement in Land and Resource Management Planning, a socio-economic profile of the Okanagan and Shuswap First Nations, and a report on the processes for documenting First Nations’ interests in land and resource management planning. Other records include correspondence, background statements, meeting agendas and memos related to the process of determining the planning, goals, approaches and outcomes of the reports.

At the time of appraisal, the records were given file codes according to schedule 144100 (Resource Management Operational Records Classification System) and were filed under the primary and secondary numbers 17550-25 : RMP : Land and Resource Management Plans – First Nations consultation case files. The actual files have the file codes 30000-20/LRMFN written on them and are from an unknown schedule that was replaced with the above mentioned schedule.

  • GR-3806
  • Series
  • 1916-1974

The series consists of volumes of grants of letters probate created in both the County Court of Merritt and the County Court of Yale between 1916 and 1974. Records typically include the name of the execut-or/rix and to whom administration of the estate was granted, and are similar in content and form to grants of letters of administration. The granting of letters probate represents one step in probating the estate of a deceased individual, and grants authority to the executor or executrix to proceed with administering the estate.

The majority of the records were filled out on Court forms 161 and 162. Some letters in volumes 1 and 2 have Succession Duty papers attached. Volume 2 includes some copies of wills annexed. The records are arranged chronologically by grant date and are not indexed.

Reference maps

  • GR-3813
  • Series
  • 1932-1995

The series contains a collection of maps used as reference in office of the Integrated Land Management Bureau and its predecessors from various ministries responsible for lands. These particular maps were transferred from the Ministry of Agriculture and Lands, Lower Mainland office in Surrey, B.C. The maps were produced by the surveys and mapping branch of the Ministry or its predecessors and cover a variety of areas in British Columbia.
The maps detail many features including roads, trails, railways, powerlines, reserved lands, surveyed lands, boundaries, campgrounds, mines, historic monuments, lighthouses, survey control stations, Forest Service lookouts, communications towers, customs offices, airports and airstrips, heliports, seaplane landings, buildings, elevations, dykes, contour swamp/marsh, intermittent lake/seasonal inundation, mud, sand, gravel, glaciers and icefields. Some maps also detail telephone lines, wells, falls, rapids, dams, cliffs, mile posts, orchards and even land lots.
The dates the maps were published do not necessarily coincide with when the data was collected to create those maps. Usually this information is present in the publication information at the bottom or top of each map. The maps would have held important reference information to Ministry workers and were probably consulted frequently. Several maps have annotations marking plots of land, new features, and other notes. Many of the maps are part of composites which can be placed next to each other to create larger maps. It is for this reason that it is believed that some duplications of the maps in this series exist. Most of the maps are topographical; however there are a few maps detailing lots and land registration as well as a few water source maps from the Water Management Division. Maps are printed on paper except for a few which are on Mylar. Maps do not appear to be arranged in any discernable order.

Maps of the following cities and areas are included in this series:

Timber sale harvesting licences from the Kamloops Forest District

  • GR-3768
  • Series
  • 1966-1983

The series consists of timber sale harvesting licences (TSHL) from the Kamloops Forest District. Timber sale harvesting licences were first introduced in 1967 and provided individuals and businesses with a permit to cut a volume of timber. This series documents the Government’s administration of timber licences in the Kamloops Forest District during the period of 1966-1983.

Each file contains correspondence, reports and may also contain maps of the cutting area. The files also contain the TSHL application, cutting permit, timber value appraisals and reappraisals, stumpage rate notices, cutting plan maps, and inspection reports. The files are numbered and arranged by the licence number.

The records were created by the Kamloops Forests District as part of the following ministries:

1963-1975 Dept. of Lands, Forests and Water Resources
1975-1976 Dept. of Forests
1976-1983 Ministry of Forests

The records have been classified as 19590-20 in the Forest ORCS.

Timber tenures from the Kamloops Forest District

  • GR-3769
  • Series
  • 1962-1986

The series consists of various timber tenures from the Kamloops Forest District of the Department of Forests and its successors. Records date from 1962-1986.

Forest tenures in this series include cutting permits, timber licences, timber sale licences, timber sale harvesting licences, licences to cut, timber berths, tree farm licences and free use permits. The licences provided the licensee with the right to harvest timber from a specific area. These files document the management of timber licences and include records relating to the issuance, administration, planning, cancellation or deletion, extension and monitoring of the tenures. Files may have A numbers, T numbers, X numbers, or other numbers specific to a type of tenure.

The files may contain a copy of the licence, forms, reports, maps of the area that will be logged, ministry approvals, operating plans, annual reports, as well as a wide variety of correspondence with the licensee.

The records were transferred to the archives under several numbers in the Ministry of Forests ORCS schedule (881261). However, most of the records in this series predate the creation of ORCS, and may have file codes from the old Ministry of Forests File Directory, such as 850-16.

Parks attendance statistical reports

  • GR-3831
  • Series
  • 1958-2012

This series contains statistical reports from BC Parks detailing parks attendance and use. The series contains four main types of forms: campground attendance sheets, marine park attendance sheets, automatic traffic counter sheet and day visit count sheets. These reports count the number of visitors renting campgrounds, docking their boats, or driving through the parks gate. The reports are also used to count revenues. Typically, reports include a section for explanations where Parks staff can add notes commenting on high/low attendance numbers due to factors such as weather and holidays.
One report discusses call center and website statistics, notably documenting how many interactions convert to sales.
Occasionally, there are reports submitted from companies operating businesses on BC Parks land (e.g. water rafting adventures) which includes attendance data.

Also within the series are files describing how the reporting system works. These records explain the use of different sheets, proper procedures for recording data (both by hand or using electronic systems), lists of parks per area and layouts of park services areas including locations of gates and counters. The records also contain instructions for using the Public Safety and Park Security Online System, though no actual security reports are included within the records.

The records are organized in different ways depending on the year. Most early records seem to divide reports into years, with reports covering all parks. Around 1970, the system changed to region-based reporting with files organized by region. Within these files, the records are further classified by park name. Finally, individual attendance sheet records are arranged by month and year. Some files include a summary of stats from all districts.

Property transfer tax court/arbitrator files

  • GR-3843
  • Series
  • 1990-2002

The series consists of property transfer tax court/arbitrator files created by the Taxation Branch between 1990 and 2002. Property transfer tax is a registration tax that was imposed in 1987 under the authority of the Property Purchase Tax Act (SCB 1987, c. 15). It requires all property purchasers to pay the tax when they register transfer at a land title office. The tax rate is based on the property's fair market value. Exemptions are available for some transactions.

If an exemption is denied by the Minister, taxpayers may appeal the decision either in the Supreme Court of British Columbia or by arbitration. The arbitrator's decision is binding and can only be appealed to the Supreme Court of British Columbia if the appeal is on a question of procedure or law. The appeal in Supreme Court is a new hearing that is not limited to the evidence and issues that were before the minister. Decisions of the Supreme Court may be appealed to the BC Court of Appeal.

The records in this series consist of case files containing correspondence, briefing notes, system screen prints and legal documents used to prepare recommendation to the Minister re appeals and to prepare documents for court cases.

The records have been classified as 45800-30 under the Property Taxation Operational Records Classification System (ORCS).
