Victoria Court of Appeal orders

The series consists of microfilmed copies of the Victoria Court of Appeal order volumes 2-7; 1915 to 1947 and bound order volumes 8-15 for the period 1948 to 1975.

The records consist mainly of orders in response to motions for leave to appeal lower court judgements and sentences, and include both civil and criminal matters. They are bound in folio number order by volume with a nominal index at the front of each volume.

Victoria District property tax assessment rolls and real estate tax records

This series consists of property tax assessment rolls and other records related to real estate or land tax in Victoria and the surrounding area. The records range in date from 1865-1886. The records may have been created by local government tax Assessors and Collectors, or the Surveyor of Taxes. Property tax assessment rolls are administered according to the Taxation Act and the Public Schools Act for the collection of real property taxes, income taxes, school taxes etc. Records record the name of the property owner, date, a description of the property and its value. Some records include additional information or also document the collection of fees related to trade licences, liquor licences, fire insurance companies, etc.

Victoria Gaol employment registers

This series contains employment registers from the Victoria Gaol, 1861-1914. These volumes contain daily reports showing the prisoner's name, with or without labour, how/where employed and sometimes "remarks". The following Volumes are missing : 1 May 1900 - 16 Sep 1901 and 1 Feb 1903 - 14 Jun 1904. The final volume contains a notes that prisoners were transferred to Saanich Prison Farm on 12 Sep 1914.

This series consists of the records of the Victoria Gaol, 1859-1914. The 107 volumes include lists of prisoners, descriptions of prisoners, sentence books, work records, charge books, employment registers, registers of clothing issued, reports of prisoners' conduct, punishment books, gaolers' reports, duty rosters and daily diaries, ration books, food account books, stores and provisions account books, financial records, doctors' record books, medical order books, receipts and 1875 correspondence from the Superintendent of Police.

Records have been grouped by subject matter, then arranged chronologically when possible. The groupings are as follows: Volumes 1 to 6, Lists of prisoners in Victoria gaol; Volumes 7 to 13, Description lists; Volumes 14 to 17, Sentence books; Volumes 18 to 22, Work records; Volumes 23 to 35, Charge books; Volumes 36 to 40, Prisoners conduct records; Volumes 41 to 107, Gaolers' records.

Victoria Supreme Court bankruptcy indexes

The series consists of several different indexes relating to bankruptcy in Victoria and across the country. The records were maintained in the Victoria Supreme Court, and although they generally relate to records created in the 1960s to 1990s, at least one volume dates to the 1920s and 1930s. Early indexes are arranged alphabetically by the surname of the bankrupt individual. Later indexes, particularly those dealing with the late 1980s, are divided first by year and then arranged alphabetically. The 1989 to 1990 index provides the name of the individual, the name of the trustee, and a file number. All file numbers appear to refer to cause book entries, which give a more detailed account of proceedings in the case.

The series also consists of a subseries of records maintained by the Victoria Supreme Court that relate to bankruptcy cases heard outside of Victoria. Many of these volumes index entries in the Canada Gazette, and list individuals in Ontario and across the country. There are also several volumes that index bankruptcies across the province, and include entries from places such as Barriere, Penticton, and Rossland.

The series consists of an affidavit and a notice regarding payments to be made in the bankruptcy case of R.F. Pickett, a Victoria merchant. The governing legislation for the case was the “Bankrupt Law Consolidation Act” of 1849. Records in the series provide a listing of Pickett’s account at the Bank of British North America and an affidavit of Henry Atkinson Tuzo, bank manager.

The series consists of civil orders issued by the Supreme Court in Victoria between 1880 and 2008. Orders dating from 1880 until December 1946 were microfilmed and the originals destroyed. Records after this period are maintained in their original form. Many, but not all, volumes dating up to the late 1970s include nominal indexes. Orders are the formal expression of the ruling of the court. The records relate to a variety of civil matters including adoptions, divorces, and bankruptcies.

The records were scheduled for full retention under Court Services ORCS (schedule 100152) 51400-25.

Victoria Supreme Court divorce cause book/case card indexes

The series consists of indexes to divorce cause books and case cards created by the Supreme Court of Victoria between 1965 and 1989. The indexes are arranged alphabetically and provide a case file number. This can then be used to locate the volume and folio number in the relevant cause book or case card, which can then in turn be used to obtain a copy of the divorce order.

Victoria Supreme Court divorce cause books and case record cards

The series consists of cause books and case record cards for divorces at the Victoria Supreme Court between 1968 and 1989. Cause books and case records cards can be used to find a volume and folio number, which can then be used to obtain a copy of the final divorce order. Cause books and case record cards are also often the only source of information for divorce cases that were dropped and never completed, as no final order would have been granted, and case files would have been destroyed.

Cause books were generally used until the mid 1970s. They were replaced by case cards, which were used until the courts turned to digital systems in the 1990s. The records are organized by case file number and provide a list of actions in a case.

Victoria Supreme Court divorce orders

The series consists of divorce orders issued by the Supreme Court of Victoria between 1877 and 1998. After October 1998, divorce orders were filed in the Supreme Court order books.

Records from 1877 to December 31, 1948 have been microfilmed. Records from 1949 onward are original paper records. The records consist of decrees nisi and absolute.

Volumes in containers 830561-0001 to 830561-0020 contain indexes.

Until 1968, divorces in BC were granted under the English Divorce and Matrimonial Causes Act of 1857 (amended 1858). Selected sections of the Act were incorporated into BC’s Divorce and Matrimonial Causes Act in 1897 (RSBC 1897, c. 62) and remained largely unchanged until 1968 when the Federal government passed the first national divorce act. This act superseded existing provincial legislation, and a Central Registry of Divorce Proceedings was also created at this time.

In 1972, BC’s Divorce and Matrimonial Causes Act was repealed and replaced with the Family Relations Act, which included provisions for issues related to custody. In 1985, the federal Divorce Act was passed, and came into effect in 1986. Under the 1985 Act, the use of decrees nisi was discontinued. Decrees nisi, which had been used inconsistently prior to the 1930s, required a waiting period before a decree absolute – the finalization of the dissolution of the marriage – could be issued. Between 1968 and 1985, decrees nisi required a three-month waiting period. After this time, a decree absolute could be applied for. During this time, a divorce was not legally in effect without a decree absolute.

Under the 1985 Divorce Act, a single court order of dissolution was issued, under which the divorce automatically comes into effect 31 days after the divorce has been granted.

Victoria Supreme Court grants of letters probate

The series consists of both bound and loose grants of letters probate created by the Victoria Supreme Court between 1946 and 1989. Grants of letters probate were issued by the court system to grant authority to an estate’s executor/trix to administer the estate in question.

Grants of letters probate provide the name of the deceased, the date and place of death, the usual residence of the deceased, and the name of the executor.

The series is arranged by volume and folio, a system which is also broadly chronological. Grants are stamped with the volume and folio number, but also with the probate number of the deceased. An index to probate numbers can be found in GR-3016 (1950-2000) or GR-2083 (1941-1950).
