Vernon Supreme Court cause book

This series consists of one cause book from the Vernon Supreme Court for civil cases between Sep 1914 and May 1937. Cause books provide the skeletal framework for Supreme Court civil action proceedings and may include the names of parties, the dates when proceedings occurred, and can be used to determine a volume and folio number for locating final orders. The series consists of orders issued by the Supreme Court in Vernon between 1901-1930 and 1958-1959. Researchers should note that orders for the period 1931 to 1957 are missing. Orders are the formal expression of the ruling of the court and judgements are the final orders issued in a case. Records relate to a variety of civil matters including divorces, bankruptcies, foreclosures, and some adoptions.

Microfilm reel B16147 contains volume 1 (May1901-November 1916) and volume 2 (October 1916-July 1920) of the orders. Container 831041-0001 contains original paper copies of orders as well as several indexes, although it is unclear to which orders these refer. They appear to index more than what was transferred in the box. When the records arrived at the Archives, they had been divided into folders based on year, and are arranged in rough chronological orders. Records relating to the same case can be found across several folders. The paper records also contain a small number of interfiled judgments.

The series consists of several cause books for bankruptcy created in the Supreme Court of Vernon between 1921 and 1980. The cause books cover the Interior Region of BC, including Vernon, Penticton, Kelowna, and Kamloops. The cause book for the period 1921 to 1973 has been microfilmed, but the corresponding index is available in the original book format only. Page 1 of the 1921-1973 cause book has a note signed by G. Hunter, C.J.B.C., dated 12 April 1921 appointing Leonard Norris as Registrar in Bankruptcy for Vernon. The volume functions as a cause book for the Bankruptcy Court of British Columbia and the Bankruptcy Court of Canada for 1921-1923. In 1923 the entries read "In the Supreme Court of British Columbia - In Bankruptcy."

Indexes are not available for the period 1973 to 1980. The index covering the period 1921 to 1973 lists the name of the party and the corresponding page in the cause book. Typical cause book entries list the plaintiff(s) and defendant(s), as well as a list of proceedings in the bankruptcy case. Entries are arranged chronologically.

Vernon Supreme Court wills

The series consists of wills filed with the Vernon Supreme Court between 1986 and 1998.

The series is arranged chronologically and by will code. The will code generally consists of a two digit number representing the year in which the will was filed, followed by a slash and a sequential will number. A single file includes multiple wills and the file title provides the range of will numbers contained within each file.

The nominal probate index available in GR-1578 provides both the name of the deceased and the sequential code number. Using this number, it is possible to locate the appropriate will file. Not all individuals listed in the probate index had wills.

The series consists of grants of letters of administration created between 1901and 1997 by the Supreme Court of Vernon. The records typically provide information on the name of the deceased and their date and place of death, as well as the name and relationship of the appointed administrator. Records in container 831179-0003 pertain to estates assigned to the Official Administrator for the North Okanagan electoral district.

The series is arranged chronologically by the date that the grant was issued. In some cases, this may be several years after the date of death.

The series consists of volumes of probate cause books created by the Supreme Court of Vernon between 1901 and 1960. A typical entry lists the name of the deceased, the file number, and a listing of activities that took place during the process of proving the will, as well as the cost of each activity. This can include, but is not limited to, a listing of affidavits that were submitted to the court, and the date that the letters of administration were granted to the execut-or/trix. In some cases, the executor or executrix is named.

Entries in the cause book are arranged chronologically by the date of the first activity in the proceedings. Each volume is accompanied by an alphabetical index.

Vernon Supreme and County Court grants of letters probate

The series consists of volumes of grants of letters probate created in both the Supreme and County Courts of Vernon between 1892 and 1997. Records typically include the name of the execut-or/rix and to whom administration of the estate was granted, and are similar in content and form to grants of letters of administration. The granting of letters probate represents one step in probating the estate of a deceased individual, and grants authority to the executor or executrix to proceed with administering the estate.The majority of the records were filled out on Court forms 161 and 162. Wills are not annexed. The records are arranged chronologically by grant date.

There are no indexes to the grants specifically, but the grants themselves could be used as an index to probate records if no other index was available. The number of the probate to which the grant applies has been written at the top of each form.

Volume one does not include an index, and several files are noted to be “from Vancouver registry.” Volumes two and three have indexes. Volume two has two separate indexes: a large index at the front of the volume and a smaller separate index tucked in the front cover of the volume. These two indexes have overlapping information, but some information may be unique to each index.
