Vancouver Supreme Court civil orders

The series consists of Vancouver Supreme Court civil orders between 1944-1976 and 1980-2005. Orders dating from April 1944 until December 1945 were microfilmed and the originals destroyed. Between ca. 1980 until 1994, civil orders were separated into different series by the court registry: statutes (“A”), motor vehicle (“B”), general civil (“C”), and foreclosures (“H”). Beginning July 1994, civil orders and judgements were once again combined into a single series of numbered volumes prefixed by the letter “S”.

The records are arranged within volumes by folio number. They were scheduled for full retention under Court Services ORCS (schedule 100152) 51400-25.

The series consists of applications, certificates of appointment, oaths, certificates of dismissal and indexes for Special Constables under the Railway Act filed at the Vancouver Court Registry between 1903 and 1996. Appointments were made by a Vancouver Police Magistrate or a Vancouver Stipendiary Magistrate (or Deputy) or the Chief Commissioner of Police for the Dominion of Canada on the recommendation of member of the Department of Investigation for the railway company. Certificates of dismissal were issued by the Superintendent or an Inspector of the Department of Investigation of the railway company. This collection has records for the Canadian Pacific Railway, the Canadian National Railway, the Great Northern Railway and Via Rail Canada.

Cause books are arranged chronologically, and case record cards are arranged by case number. Cause book and case record card entries typically include the date of filing, the date and place of marriage, the names of the parties and their solicitors, and an account of the case proceedings. Cause books were used by the courts until approximately the mid-1970s. They were replaced by case record cards, which were used until the courts turned to digital systems in the 1990s. Cause books and case record cards are also often the only source of information for divorce cases that were dropped and never completed, as no final order would have been granted, and case files would have been destroyed.

The records are arranged by case number, which can be found by using the indexes in GR-1704. Some years, the case numbering sequence was re-set. As such, case numbers within this series have been used repeatedly. Make note of the case number and year when the case started when matching records. The original bound volumes for records 1/1893 to 3300/1961 were destroyed after microfilming; retrieve records using microfilm. Vancouver County Court orders and judgements

This series consists of orders and judgements from the Vancouver County Court for civil cases between 1980-1994. Orders are the formal expression of the ruling of the court, judgements are the final orders issued in a case, and reasons for judgement provide the court's rationale. All BC County Courts ceased to exist after their merger with the BC Supreme Court in 1990. Any records dated after 1 July 1990 are for County Court proceedings that were initiated prior to that date.

Vancouver Supreme Court bankruptcy indexes

The series consists of indexes from 1950-1963 and 1988-1992 for Vancouver Supreme Court bankruptcies. Indexes for 1988-1992 were created by the Vancouver Supreme Court registry as computer-generated printouts that were microfiched and later scanned. Microfiche copies do not include later amendments that are reflected in the scanned versions. Archives staff also have access to an internal index for 1956-1990.

Delgamuukw court records

The series consists of transcripts of court proceedings, cross-examinations, examination of discovery, exhibit indices, closing statements, briefs, and reasons for judgement of Delgamuukw v. The Queen. The case was heard in the Smithers Supreme Court between 1987 and 1989 (case file 0843). Following the hearings in Smithers, the case reached the BC Court of Appeal and eventually made its way to the Supreme Court of Canada where a landmark ruling was finally issued in 1997.

The transcripts of the proceedings at trial, which consist of 369 spiral-bound volumes, provide a wealth of information on First Nations genealogies, traditional resource knowledge, and language, as well as details of the extent of traditional territories. The series consists of more than 23,000 pages of trial transcript and includes the testimonies of more than 60 witnesses. The series also includes the reasons for judgment. Gitxsan hereditary chief Delgamuukw (Albert Tait), who filed the Statement of Claim, passed away shortly before the trial opened in 1987 and was succeeded by Kenneth Muldoe who was in turn succeeded by his brother, artist Earl Muldon. The claim covered 133 traditional territories, which amounted to 58,000 square kilometers of northwestern British Columbia. Peter R Grant served as lead counsel for the Gitxan and Wet-suwet'en chiefs, and D.M.M. Goldie served as lead counsel for the Province.

The files are arranged as they arrived from the Smithers court registry. Boxes 1 to 13 contain the proceedings at trial. Boxes 16 and 17 include lists of exhibits which provide information on relevant archival collections held in repositories across the province.

There are also slides depicting Vancouver, the construction of BC Place in 1982-1983, and Ladysmith.

The fonds comprises CBC Radio productions, mainly produced at CBC Vancouver by Don Mowatt. The programs include musical concerts, documentaries, radio plays and features. There are also several programs from "Testament", for which he was appointed Executive Producer in 1983. Most of this material was either commissioned or acquired by the divisions of Expo 86 Corporation responsible for marketing and communications. It consists of promotional material packaged in several different forms for mass media outlets, and informational material directed to specialized audiences such as corporations and governments. The series also includes media monitoring tapes of news coverage and footage documenting the planning, progress and construction of the exposition. Most of the material dates from March 1983 to the opening days of Expo in early May 1986.
