Fort Nanaimo fonds

The fonds consists of the wastebook [accounts book] of Fort Nanaimo, 1854-1861,reflecting the various activities of the HBC in the Nanaimo area. It also includes a transcript copy of Fort Nanaimo correspondence between Joseph W. McKay and James Dougas, 1852 to 1853, and a transcript copy of the Fort Nanaimo journal, 1855 to 1857.

Vancouver Island Supreme Court of Civil Justice bench book

Series consists of one bench book for Colony of Vancouver Island Supreme Court of Civil Justice civil and criminal cases heard by Judge David Cameron at Fort Victoria from November 1853 to January 1856 and one criminal case at Nanaimo in May 1854. It also includes civil cases heard at Victoria in the Inferior Court of Civil Justice in 1856. The volume additionally served as a criminal record book for 1853, a cause book for 1856, and a Registrar's record book for 1853. It opens with a notation that Judge Cameron's commission was read and that he took his seat on 6 October 1853. The Registrar also notes that he received the court seal from Judge Cameron.

Informations, warrants and convictions

This series consists of informations, warrants and convictions from the Nanaimo district. Records may be from the Nanaimo County Court, Supreme Court or Magistrate's Court. Informations are forms in which a witness submits evidence against someone accused of a crime. It includes a summary of the information and personal information of the witness and accused. Several different kinds of warrants are included, such as warrants to apprehend a suspect, warrants to commit someone to gaol and search warrants.

Records from 1872-1889 were grouped together in several volumes beginning with a cardboard name tag; these have been broken into multiple files for preservation. They are arranged mostly chronologically and all include a mixture of different types of records. Some records relate to the Comox District. Files 9 to 16 are not arranged chronologically and include a range of dates that overlap with other volumes.

Most records from 1900-1916 are signed by Stipendiary Magistrate, J.H. Simpson. These forms were removed from a Shannon file where the order of filing was broadly (not strictly) chronological.

Registers of brands (cattle and horses)

This series contains registers of brands (for both cattle and horses) kept by district recording offices prior to 1914. Registers pertain to brands registered in Cariboo, Similkameen, Okanagan, and Nanaimo districts. This series may be used in conjunction with other district brands registers (GR-0409 - GR-0412) and with post-1914 brands registers (GR-1488). A regulated system of branding or marking livestock in British Columbia began with the Cattle Ordinance of 1869 (32 Vic., No. 114) which established a procedure whereby cattle brands and other distinctive markings could be registered with district magistrates for a fee of 25¢. The system developed further with the Cattle Marking Act, 1875 (BCS 38 Vic. c.14) which defined "cattle" to include "horses, mares, fillies, foals, geldings, colts, bulls, bullocks, cows, heifers, steers, calves, sheep, hogs, mules and asses." Recording officers were appointed by cabinet for each electoral district and were authorized to keep a register of brands and markings; local justices of the peace were empowered to ensure that brands were not duplicated, obliterated, or defaced and penalties were set for infractions. In 1881 the registration fee was raised to 50 ¢ (Cattle Brands Act, 44 Vic. c.4) and in 1888 provisions were made for regional cattle districts, whose boundaries were not necessarily identical to those of electoral districts. A distinction was also made in 1888 between the Mainland and Vancouver Island: in Mainland districts, brands were to be registered by an "authorized recording officer" usually the local Government Agent while on the Island brands were to be recorded by district magistrates. These distinctions were abolished in 1894 by the Cattle Act Amendment Act which confirmed Government Agents as "authorized recording officers" throughout the province. The procedure of registering brands was streamlined and centralized by the Brand Act of 1914 (4 Geo. 5 c.9). With this act, provision was made for a Recorder of Brands (responsible to the Minister of Agriculture) and a three man Board of Brand Commissioners. After 1 July 1914 all applications for brand registers or transfers were made through the Recorder's office in Victoria. The fee for brand registration was increased to $1.00 and henceforth all brands were to be renewed annually at a cost of 50 ¢. GR 1487 consists of brands registers and indexes kept prior to 1914. In most cases, the registers show the name and address of brand owners, the date and certificate number of the brand registration, and a description of registered brands and markings. Registers pertain to both cattle and horses. Since the districts covered by the registers were not rigidly defined, researchers may have to consult more than one volume to locate specific brands or brand owners. This series may be used in conjunction with GR 0409 GR 0412 (Registers for Cariboo, Lillooet, and New Westminster, 18701913) and with GR 1488 (post1914 brands registers and indexes).

Nanaimo Supreme Court Registrar's assize record books

The series consists of two registrar's assize record books. One dates from December 1882 to July 1884, and the second dates from 1887 to possibly 1888. The first volume was kept by the registrar (Marshall Bray) and served as a minute book, bench book and record book. It includes several Petit and Grand Jury lists. The second volume was not kept by Bray, but was presumably kept either by his successor or another courts employee working in a similar capacity.

Both volumes include a great deal of witness statements concerning particular cases. Many of the cases deal with Chinese or Indigenous residents of Nanaimo and the surrounding area. The statements are frequently lengthy and often appear to have been recorded verbatim. There are notes regarding translations.

Series consists of cause books from the Nanaimo Supreme Court from 1887-1890 and 1894-1948. Cause books provide the framework for Supreme Court civil action cases and may include the names of parties, the dates when proceedings occurred, and can be used to determine volume and folio numbers for locating final orders and/or judgements. Cause books were used by the courts until approximately the mid-1970s. They are often the only source of information for divorces that were not finalized since no final order would have been granted and case files are destroyed.
