Nelson Supreme Court probate files

The series consists of probate files created by the Nelson Supreme Court between 1895 and 2007.
The records are filed alphabetically within the year, 1895-1922, although some names are out of the alphabetical sequence. Files after 1922 are filed chronologically.

Files 27/1939 to 43/1940 were accidentally destroyed prior to microfilming.

Probate files from 1990-2007 are in textual format.

The file number refers to the number assigned by the court registry rather than to the file's physical order in the box. Each year, the numbering system restarted from 1 and ascended chronologically. Thus, it is possible to have multiple files with the same number in a box, as they date from different years.

Golden Supreme Court civil orders

The series consists of civil orders created in the Supreme Court in Golden between 1960 and 1991. Orders are a formal expression of the court’s will, and orders in this series cover a variety of issues, including adoption, probate and divorce.

The series is arranged by volume, and then by folio according to filing date. Some folios may not be clearly labeled, may not be filed chronologically or may have duplicated folio numbers. Each folio is labeled with a coded registry number. Some additional documents may be interfiled with numbered folios, such as affidavits. There is only one partial index for volume 4 included.

The dates listed in the file list are derived from the date on which the order was filed. Although the filing date for the majority of the records corresponds closely to when the order was issued, this is not always the case, and there are instances in which orders were filed months after being issued.

Originally the files were arranged in Shannon files based on volume number. For space and preservation reasons, the records have been placed in acid-free folders. Each volume was split into multiple folders, which are linked by volume number.

Fernie Supreme Court grants of letters probate

The series consists of grants of letters probate issued by the Fernie Supreme Court between 1974 and 1986. The grants were issued on “Form A.” A typical record shows when and where an individual died, and to whom the letters probate were granted. The granting of letters probate represents one step in probating the estate of a deceased individual, and grants authority to the executor or executrix to proceed with administering the estate.

The records are arranged chronologically and list the probate number at the top of each record. Researchers can either use this number, or the name of the deceased individual, to search in GR-2998 for the actual probate file. These files sometimes include copies of the deceased’s will, and other documents related to the administration and disposal of the estate

Series consists of grants of letters of administration created by the Supreme Court in Fernie between 1929 and 1985. Many records have the will annexed. The series also consists of one volume created by the County Court that appears to have been in the custody of the Supreme Court before being transferred to the Archives.

Golden Supreme and County Court probate cause book

The series consists of one volume of a cause book listing the proceedings in matters concerning probates proved in the Supreme and County Courts of Golden between 1955 and 1980. The cause book is arranged chronologically, and lists the probate number, the name of the deceased, and a list of the activities involved in proving a will, along with their associated costs. The volume can be used as a backup index to Golden’s probate records. The cause book also lists which estates were administered by the Official Administrator.

There is a nominal index to the volume in the front of the ledger.

Cranbrook Supreme Court Letters of administration and letters probate

The series consists of letters of administration and letters probate from Fort Steele, 1906-1909 and from the Supreme Court of Cranbrook, 1906-1978. It includes Form A, Form B, and Form C, each arranged by date of filing. Form A are grants of letters probate in which the deceased individual named the executor of their estate in their will. Form B are grants of letters of administration in which the deceased left a will but named no executor, or the executor was unable to fill the role, so another individual is named. Form C are grants of letters of administration in which the deceased left no will (died intestate), so an individual is named as executor.
