Victoria Supreme Court bankruptcy records

The series consists of an affidavit and a notice regarding payments to be made in the bankruptcy case of R.F. Pickett, a Victoria merchant. The governing legislation for the case was the “Bankrupt Law Consolidation Act” of 1849. Records in the series provide a listing of Pickett’s account at the Bank of British North America and an affidavit of Henry Atkinson Tuzo, bank manager.

The series consists of civil orders issued by the Supreme Court in Victoria between 1880 and 2008. Orders dating from 1880 until December 1946 were microfilmed and the originals destroyed. Records after this period are maintained in their original form. Many, but not all, volumes dating up to the late 1970s include nominal indexes. Orders are the formal expression of the ruling of the court. The records relate to a variety of civil matters including adoptions, divorces, and bankruptcies.

The records were scheduled for full retention under Court Services ORCS (schedule 100152) 51400-25.

New Westminster Supreme Court civil cause books and case record cards

Series consists of civil cause books and case record cards from the New Westminster Supreme Court from September 1881 to April 1977. There are no cause books for November 1947 to August 1949 or for July to December 1975 and volume 11 (1956) is missing. Cause books and case records cards provide the framework for Supreme Court civil action cases and may include the names of parties, the dates when proceedings occurred, and can be used to determine volume and folio numbers for locating final orders and/or judgements. Cause books were used by the courts until approximately the mid-1970s. They were replaced by case record cards, which were replaced by digital systems in the 1990s. They are often the only source of information for divorces that were not finalized since no final order would have been granted and case files are destroyed.

Records are arranged chronologically by the date a case was initiated. Case file numbers were then assigned sequentially and include the year a case was initiated. Original textual records prior to 1949 were destroyed after microfilming. Vancouver Supreme Court indexes to cause books and case record cards

Fernie Supreme Court civil cause books

Series consists of cause books from the Fernie Supreme Court for civil cases between 1905-1977. Cause books provide the framework for Supreme Court civil action cases and may include the names of parties and their solicitors; the dates when proceedings occurred, including the issuing of orders; and fees charged. They are often the only source of information for divorces that were not finalized since no final order would have been granted and case files are destroyed.

The records are arranged chronologically by the date a case was initiated. Case file numbers were then assigned sequentially and include the last two digits of the year (e.g., 1/24 for the first case initiated in 1924). The records were scheduled for retention under Court Services ORCS (schedule 100152) 53200-20.

Victoria Supreme Court bankruptcy indexes

The series consists of several different indexes relating to bankruptcy in Victoria and across the country. The records were maintained in the Victoria Supreme Court, and although they generally relate to records created in the 1960s to 1990s, at least one volume dates to the 1920s and 1930s. Early indexes are arranged alphabetically by the surname of the bankrupt individual. Later indexes, particularly those dealing with the late 1980s, are divided first by year and then arranged alphabetically. The 1989 to 1990 index provides the name of the individual, the name of the trustee, and a file number. All file numbers appear to refer to cause book entries, which give a more detailed account of proceedings in the case.

The series also consists of a subseries of records maintained by the Victoria Supreme Court that relate to bankruptcy cases heard outside of Victoria. Many of these volumes index entries in the Canada Gazette, and list individuals in Ontario and across the country. There are also several volumes that index bankruptcies across the province, and include entries from places such as Barriere, Penticton, and Rossland.

The series consists of several cause books for bankruptcy created in the Supreme Court of Vernon between 1921 and 1980. The cause books cover the Interior Region of BC, including Vernon, Penticton, Kelowna, and Kamloops. The cause book for the period 1921 to 1973 has been microfilmed, but the corresponding index is available in the original book format only. Page 1 of the 1921-1973 cause book has a note signed by G. Hunter, C.J.B.C., dated 12 April 1921 appointing Leonard Norris as Registrar in Bankruptcy for Vernon. The volume functions as a cause book for the Bankruptcy Court of British Columbia and the Bankruptcy Court of Canada for 1921-1923. In 1923 the entries read "In the Supreme Court of British Columbia - In Bankruptcy."

Indexes are not available for the period 1973 to 1980. The index covering the period 1921 to 1973 lists the name of the party and the corresponding page in the cause book. Typical cause book entries list the plaintiff(s) and defendant(s), as well as a list of proceedings in the bankruptcy case. Entries are arranged chronologically.

Kelowna Supreme Court civil orders and judgements

Orders are the formal expression of the ruling of the court and judgements are the final orders issued in a case. Records relate to a variety of civil matters including divorce, estates, bankruptcy, foreclosure, and some adoptions. In later years, divorce, adoption, and probate orders may also be located within their own series.

Orders and judgements are interfiled. From 1923-1961, records were arranged by entered date and assigned a sequential folio number by the court registry (nos. 1-1305). From 1962-1973, the assigned folio numbering sequence was re-set each year, starting with 1/1962. Beginning in 1974, all orders and judgements for a case are filed together by case file number. This means that records of varying dates are interfiled. Box 6, folder 12 includes orders for cases initiated but not finalized before 1974. The records were scheduled for full retention under Court Services ORCS (schedule 100152) 51400-25.

This series contains New Westminster Supreme Court orders from January 1940 to May 1945 and January 1948 to December 2004 (predominantly up to April 2001). Orders are the formal expression of the ruling of the court and judgements are the final orders issued in a case. Records relate to a variety of civil matters including divorces, bankruptcies, foreclosures, probates, and some adoptions.

Records are arranged by volume and folio number as assigned by the court registry. Beginning in May 1950, orders and judgements were separated and volume numbers 49-108 are duplicated. Beginning in March 1976, orders and judgements are interfiled. Between October 1990 and December 2004, orders, default judgements, certificates, and determinations related to financial cases were separated into their own volumes, 148-204, once again creating duplicated volume numbers. Researchers are encouraged to check volume numbers against dates when searching for specific records. Most, but not all, volumes include indexes or volume file lists. However, beginning in July 1990, volumes include a file list by case number only. The records were scheduled for full retention under Court Services ORCS (schedule 100152) 51400-25.
