Scope and content

The series consists of Nanaimo Supreme Court civil orders and reasons for judgment, 1900-2002. Civil court orders are the formal expression of the rulings of the court, whereas the reasons for judgment are the explanation that the court gives at the conclusion of a hearing, explaining why an order is being made.

The civil court orders date from 1900 to 1994 and contain divorce orders interfiled throughout. The orders are generally arranged by volume and folio number. The orders were originally added to a shannon file volume in file date order and given folio numbers from 1 to 200 or 300. Each volume is indexed.

Reasons for judgment, filed between 1985 and 2002, were not intermingled, but rather were housed separately in accordion files. They are arranged by court file number within each folder.

Immediate source of acquisition

Records in containers 831029-0001 to 831029-0035 were transferred to the Archives in 2002. Records in containers 831029-0036 to 831029-0048 were transferred from the Nanaimo Court Registry in January 2016.

Microfilmed records on reel B06054(1) were transferred from the Ministry of the Attorney General in 1989.

Arrangement

Files in containers 831029-0001 to 831029-0048 were originally housed in shannon folders upon their transfer to the Archives. For preservation purposes, these records were re-housed in acid free folders. The processing archivist divided each shannon file into two acid-free folders. However, the original arrangement has been otherwise maintained, and the volume number is evident in the file title. A style of cause index was usually included at the top of each shannon folder; this has been placed at the beginning of the second folder for each volume. Shannon files were originally arranged by date stamped folio numbers, with the first order in each volume located at the back of the file. This order has been maintained in the acid-free folders, so lower-numbered folios are towards the back of each file.
